1. Purpose
Customer hereby authorizes Authorized Agent to access and manage Customer’s CARB CTC-VIS account (the "Portal") for the purpose of managing compliance requirements related to emissions testing.
2. Scope of Authorization
Authorized Agent is permitted to perform the following actions on behalf of Customer:
● Managing test due dates to ensure timely compliance.
● Scheduling emissions tests as required by regulations.
● Updating relevant information within the Portal as needed.
The Authorized Agent is NOT responsible for paying any compliance fees on behalf of the Customer. All such fees remain the sole responsibility of the Customer.
3. Limitations
Authorized Agent's access is limited to the services outlined above. Unauthorized use of the Portal beyond these services is strictly prohibited. Customers retain full responsibility for compliance with CARB regulations. 4. Duration & Termination
This authorization remains in effect until revoked in writing by either party. Customers may revoke this authorization at any time with written notice to the Authorized Agent. Authorized Agent may also terminate this agreement upon written notice to the Customer.
5. Liability
Customer acknowledges that the Authorized Agent is acting solely as a facilitator and is not responsible for any penalties, fines, or compliance failures. Authorized Agent is not liable for system errors or third-party issues related to the Portal.
6. Indemnification
Customer agrees to indemnify and hold harmless Authorized Agent from any claims, liabilities, or damages arising from the use of the Portal, except in cases of gross negligence or willful misconduct.
7. Governing Law
This Contract shall be governed by the laws of the State of California.
8. Acknowledgment & Signatures
By submitting form, both parties acknowledge and agree to the terms outlined in this Contract.
