CTC Intelligence — Terms of Service

These Terms of Use (“Terms”) govern the use of the Clean Truck Check Authority website, CTC Intelligence platform, services, automated compliance tools, mobile applications, communications, and related products operated by ASAH Industries DBA Clean Truck Check Authority (“CTCA,” “Company,” “we,” “our,” or “us”).

By accessing or using our services, website, portal, or purchasing a subscription, you agree to these Terms.

1. Services Overview

CTCA provides services including but not limited to:

  • Mobile OBD emissions testing
  • Opacity testing
  • CTC-VIS support services
  • Fleet compliance assistance
  • Automated compliance monitoring
  • CTC Intelligence hardware and software services
  • SMS and email communications

Services may be modified, expanded, suspended, or discontinued at any time.

2. Account Registration

To use our Services, you must create an account through our online portal. You agree to provide accurate and complete information during registration and to maintain the accuracy of that information at all times. You are responsible for maintaining the confidentiality of your login credentials and for any activity occurring under your account.

3. Subscriptions, Billing, and Payments

Monthly Plan
  • $30 per month per vehicle
  • $45 non-refundable activation fee
  • Automatic recurring billing
Annual Plan
  • $300 annually per vehicle
  • No activation fee
  • Automatic annual renewal unless canceled in accordance with these Terms

Pricing may change at any time with notice.


Subscription Commitment

Monthly subscription customers agree to a minimum 12-month service commitment.

If a monthly subscription is canceled before completion of the 12-month term, CTCA reserves the right to accelerate and collect the remaining balance of the agreement.

Annual plans are prepaid and non-refundable except where required by law.

Activation Fees

Activation fees are non-refundable once account setup, device provisioning, or activation has begun.

Automatic Billing & ACH Authorization

By providing payment information, including credit card, debit card, or ACH banking information, you authorize CTCA and its payment processors to automatically charge your selected payment method for:

  • Subscription charges
  • Activation fees
  • Outstanding balances
  • Applicable taxes and fees

Recurring billing authorization remains active until canceled in writing and all outstanding balances are paid.

Returned ACH payments, failed transactions, chargebacks, or payment reversals may result in:

  • Service suspension
  • Additional fees
  • Collections activity
  • Account termination

For recurring autopay subscriptions, CTCA may require a valid non-prepaid payment card.

Prepaid cards may not be accepted for recurring billing services.

Payment methods with expiration dates within 90 days may be rejected or require updating before enrollment in automatic billing.

Failed Payments

If payment fails, CTCA may:

  • Retry billing attempts
  • Suspend services or platform access
  • Restrict device functionality
  • Require updated payment information

Accounts delinquent beyond 15 days may be suspended or terminated.

CTCA reserves the right to disable platform access and automated testing functionality for delinquent accounts.

4. Device Usage & Limited Warranty

CTC Intelligence devices are assigned to specific vehicles and may not be transferred between vehicles without company approval.

Customers are responsible for:

  • Proper installation
  • Device protection
  • Maintaining compatible vehicle systems
  • Reporting issues promptly
  • Preventing unauthorized tampering or misuse

All CTC Intelligence devices include a limited one (1) year warranty beginning on the date of shipment.

The warranty covers manufacturer defects and hardware malfunctions under normal intended use only.

The warranty does not cover:

  • Accidental damage
  • Water damage
  • Fire damage
  • Improper installation
  • Unauthorized modifications
  • Vehicle electrical damage
  • Theft or loss
  • Physical abuse or impact damage

CTCA reserves the right to inspect returned devices before approving warranty replacement.

Replacement fees may apply for lost, stolen, tampered, or non-warranty devices.

5. No Resale or Unauthorized Use

Devices and Services may not be resold, leased, transferred, or tampered with without prior written authorization from CTCA.

6. Compliance and Legal Use

All users agree to use the Services in full compliance with applicable state and federal laws, including but not limited to CARB regulations and FMCSA rules. Providing false information, tampering with devices, or using the Services for unlawful purposes may result in immediate termination of service and legal action.

7. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of California. Any disputes will be resolved exclusively in the courts of Orange County, California.

8. Compliance Responsibility

While CTCA provides compliance assistance and automated tools, customers remain responsible for:

  • Maintaining legal compliance
  • Accurate vehicle information
  • Timely repairs
  • Fleet management decisions
  • Regulatory obligations

CTCA does not guarantee avoidance of CARB penalties, citations, or enforcement actions.

9. SMS Communications & Consent

By providing your mobile phone number, you consent to receive SMS communications from CTCA related to:

  • Compliance reminders
  • Testing notifications
  • Billing alerts
  • Device notifications
  • Account updates
  • Service communications
  • Verification codes

Message frequency may vary.

Message and data rates may apply.

Consent to receive SMS messages is not a condition of purchase.

You may opt out at any time by replying STOP.

Carrier delivery is not guaranteed.

Supported carriers are not liable for delayed or undelivered messages.

10. Electronic Communications

By using our services, you consent to receive electronic communications including:

  • Emails
  • SMS messages
  • Billing notices
  • Legal notices
  • Platform notifications

Electronic communications satisfy legal communication requirements.

11. Data Collection & Third-Party Services

To operate our services, platform, automated compliance tools, billing systems, and communications, CTCA may collect, process, store, and transmit information through trusted third-party service providers and infrastructure partners.

These providers may assist with:

  • Payment processing
  • SMS and email communications
  • Authentication and account security
  • Device connectivity and telematics services
  • Website hosting and infrastructure
  • Analytics and performance monitoring
  • Customer support and fraud prevention

Information processed may include:

  • Name
  • Contact information
  • Billing information
  • Vehicle information
  • Device identifiers
  • Compliance and testing information
  • Account activity
  • Communication records

By using our services, you consent to the processing of information by these providers in accordance with applicable laws and our Privacy Policy.

12. Prohibited Use

Users may not:

  • Misuse the platform or services
  • Tamper with devices
  • Attempt unauthorized access
  • Reverse engineer software or systems
  • Use services unlawfully
  • Interfere with compliance systems

Violation may result in suspension, termination, and legal action.

13. Intellectual Property

All website content, branding, graphics, software, platform materials, and related intellectual property remain property of ASAH Industries unless otherwise stated.

14. Disclaimer of Warranties

Services are provided “as is” and “as available.”

CTCA disclaims warranties including:

  • Merchantability
  • Fitness for a particular purpose
  • Continuous availability
  • Error-free operation

15. Limitation of Liability

To the maximum extent permitted by law, CTCA shall not be liable for:

  • Lost profits
  • Business interruption
  • Regulatory penalties
  • Lost data
  • Indirect damages
  • Consequential damages

Total liability shall not exceed the amount paid by the customer to CTCA during the preceding 12 months.

16. Changes To Terms

CTCA may update these Terms at any time.

Continued use of services constitutes acceptance of revised Terms.
